Welcome to Canada's National Ship-source Oil Pollution Fund (SOPF).
Over the years, Canada has fashioned a unique well-functioning domestic compensation regime that ensures that victims of oil pollution caused by ships are promptly and adequately compensated.
Canada, however, subscribes to the “polluter pays” principle. To the extent that where compensation is paid out of the SOPF, the Administrator is bound to take all reasonable steps to recover the amount from the party responsible for the spill.
As of January 2, 2010, new amendments to the Marine Liability Act (MLA) dealing with ship source oil pollution came into force, including provisions implementing two further international instruments.
